Acceptance of Terms
Welcome to Daily Drift. By downloading, installing, or using the Daily Drift mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
Description of Service
Daily Drift is a personal journaling application that allows you to record your daily thoughts, reflections, and moods. All data you create within the App is stored locally on your device and is never transmitted to our servers.
License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use.
Your Content and Data
Ownership
You retain all rights and ownership of your journal entries, moods, and any other content you create in the App ("Your Content"). We do not claim any ownership rights to Your Content.
Local Storage
Your Content is stored exclusively on your device. We do not have access to, collect, or store Your Content on our servers. You are solely responsible for maintaining backups of Your Content through the App's export feature.
Data Loss
We are not responsible for any loss of Your Content. Uninstalling the App will permanently delete all Your Content from your device. We recommend regularly exporting your data as a backup.
Prohibited Uses
You agree not to use the App to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Attempt to reverse engineer, decompile, or disassemble the App
- Remove or modify any copyright, trademark, or other proprietary notices
- Use the App in any way that could damage, disable, or impair our services
- Attempt to gain unauthorized access to any part of the App or its systems
Intellectual Property
The App, including its design, features, functionality, graphics, and user interface, is owned by Daily Drift and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.
Third-Party Services
The App and website use the following third-party services:
- Firebase Remote Config: For app configuration and update notifications
- Firebase Crashlytics: For crash reporting and diagnostics to improve app stability
- Vercel Analytics: For website traffic and performance analytics (website only)
Your use of these services is subject to their respective terms and privacy policies. Please see our Privacy Policy for detailed information about what data is collected by these services and how it is used. We are not responsible for the practices of third-party services.
Updates and Modifications
We may update the App from time to time to add new features, fix bugs, or improve performance. We may also modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the App will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy or reliability of any content
Limitation of Liability
To the maximum extent permitted by law, Daily Drift shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the App
- Any unauthorized access to or use of your device
- Any bugs, viruses, or other harmful code that may be transmitted through the App
- Any errors or omissions in any content
- Loss of Your Content for any reason
Indemnification
You agree to indemnify and hold harmless Daily Drift and its affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.
Children's Privacy
Daily Drift does not collect personal information from anyone, including children under 13. All data created in the App is stored locally on your device and is never transmitted to our servers. The App is designed for general audiences and does not require any personal information to use.
Termination
You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or suspend your access to the App at any time, with or without notice, for any reason, including violation of these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Daily Drift operates, without regard to its conflict of law provisions.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Daily Drift regarding the use of the App and supersede any prior agreements.
